Rubbish Removal Swiss Cottage Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Swiss Cottage provides waste and rubbish collection services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following definitions apply:

1.1 "Company" means Rubbish Removal Swiss Cottage, the service provider supplying rubbish removal and related waste collection services.

1.2 "Customer" means any individual, business, or organisation requesting or using the services of the Company.

1.3 "Services" means rubbish removal, waste collection, bulky waste clearance, and any related services offered by the Company.

1.4 "Waste" means any items, materials, or rubbish presented by the Customer for collection and disposal in accordance with these Terms and applicable waste regulations.

1.5 "Site" means the property, premises, or location where the Services are to be carried out.

2. Scope of Services

2.1 The Company provides rubbish removal and waste collection services within Swiss Cottage and surrounding areas, subject to availability and any operational limitations.

2.2 The Services may include collection of household waste, commercial waste, garden waste, bulky items, and general rubbish, subject to compliance with relevant waste legislation and any exclusions specified in these Terms.

2.3 The Company reserves the right to refuse collection of any Waste that is prohibited, hazardous, unsafe to handle, improperly presented, or in breach of applicable regulations.

3. Booking Process

3.1 Bookings for Services can be made by telephone, email, or through any booking system operated by the Company. All bookings are subject to confirmation and acceptance by the Company.

3.2 When making a booking, the Customer must provide accurate information, including the collection address, access details, description and approximate volume or weight of the Waste, and any special circumstances relevant to the Site.

3.3 The Company may provide an estimated price based on the information supplied by the Customer. This estimate may be revised if the actual Waste or conditions at the Site differ from the information provided at the time of booking.

3.4 The Customer is responsible for ensuring that someone authorised is present at the Site at the agreed time of collection, unless otherwise agreed in writing with the Company.

3.5 The Company reserves the right to refuse or cancel any booking where it reasonably believes the Services cannot be carried out safely, lawfully, or in accordance with these Terms.

4. Access and Site Conditions

4.1 The Customer must ensure that the Company and its staff have safe and reasonable access to the Site at the agreed time, including any necessary keys, codes, parking permissions, or building entry instructions.

4.2 The Customer must ensure that the Waste is ready for collection and is located in an area that can be safely accessed and cleared by the Company without undue risk, obstruction, or delay.

4.3 If access to the Site is restricted, delayed, or unsafe due to circumstances beyond the Company’s control, the Company may charge a waiting fee, reschedule the Service, or treat the visit as a failed collection and charge a call-out fee.

4.4 The Customer is responsible for obtaining any permits or consents required for the Company’s vehicles to park or load at or near the Site.

5. Waste Presentation and Restrictions

5.1 The Customer must ensure that all Waste to be collected is clearly identified and separated from items that are not to be removed.

5.2 The Company will not collect materials classified as hazardous or special waste, including but not limited to asbestos, certain chemicals, clinical waste, pressurised containers, or any items prohibited by law for standard collection.

5.3 If the Customer presents hazardous or prohibited Waste for collection without prior written agreement, the Company may refuse to remove such items and may charge an additional fee for any time or costs incurred.

5.4 The Customer must notify the Company in advance if any Waste includes electrical equipment, mattresses, fridges, freezers, or other items requiring special handling or disposal procedures.

6. Pricing and Payment Terms

6.1 Prices for the Services are based on factors including the volume, weight, and type of Waste, labour involved, access to the Site, and any additional services requested by the Customer.

6.2 Unless otherwise stated, quoted prices are exclusive of any applicable taxes or charges that may apply under law. Any such amounts will be added to the final invoice where relevant.

6.3 The Company may provide a price estimate prior to attending the Site. Final charges will be confirmed once the Waste has been assessed in person and before the collection is undertaken, where reasonably practicable.

6.4 Payment is due on completion of the Service, unless otherwise agreed in writing. The Company may accept payment by cash, card, bank transfer, or other methods as notified to the Customer.

6.5 For business Customers, the Company may agree credit terms. Where credit terms are agreed, invoices must be paid within the period specified on the invoice. The Company reserves the right to charge interest and recovery costs on overdue amounts in accordance with applicable law.

6.6 The Customer may not withhold payment or make set-offs against the Company’s invoices unless required to do so by law or previously agreed in writing.

7. Cancellations and Rescheduling

7.1 The Customer may cancel or reschedule a booking by giving the Company reasonable notice prior to the agreed collection time.

7.2 If the Customer cancels the booking less than 24 hours before the scheduled Service, the Company reserves the right to charge a cancellation fee to cover administrative and scheduling costs.

7.3 If the Customer is not present at the Site at the agreed time, or if the Company is unable to carry out the Service due to lack of access or other circumstances within the Customer’s control, the visit may be treated as a failed collection and a call-out charge may be applied.

7.4 The Company may cancel or postpone the Service due to operational or safety reasons, including adverse weather, vehicle issues, staff sickness, or legal restrictions. In such cases, the Company will endeavour to provide as much notice as reasonably possible and to arrange a suitable alternative time.

8. Customer Responsibilities

8.1 The Customer is responsible for ensuring that all information provided to the Company is accurate and complete, including details of the Waste, Site conditions, and any risks or access issues.

8.2 The Customer must comply with all applicable laws and regulations relating to the Waste and the Site, and must not request the Company to act in any way that would breach such laws or regulations.

8.3 The Customer must remove or secure any personal or valuable items from areas where the Company will be working and is responsible for identifying items that are not to be taken as Waste.

8.4 If the Customer or any third party interferes with, obstructs, or abuses the Company’s staff or contractors, the Company may suspend or terminate the Service with immediate effect and may recover any losses incurred.

9. Company Responsibilities and Liability

9.1 The Company will provide the Services with reasonable care and skill and in accordance with applicable waste management regulations.

9.2 The Company will take reasonable care when carrying out the Services at the Site. However, the Customer acknowledges that moving bulky items or large volumes of Waste can carry a risk of minor damage to floors, walls, or fixtures. The Customer should take reasonable steps to protect surfaces or items that could be affected.

9.3 The Company’s liability for damage to the Customer’s property arising from its negligence shall, where permitted by law, be limited to the reasonable cost of repair or replacement, subject to any applicable insurance arrangements.

9.4 The Company shall not be liable for any loss of profits, loss of business, loss of opportunity, or any indirect or consequential loss suffered by the Customer arising out of or in connection with the provision of the Services.

9.5 Nothing in these Terms shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

10. Waste Handling and Regulations

10.1 The Company will handle, transport, and dispose of Waste in accordance with applicable UK waste legislation and any relevant local regulations, using appropriately licensed facilities and carriers.

10.2 Title to the Waste shall pass to the Company upon loading into the Company’s vehicle, unless otherwise required by law or agreed in writing.

10.3 The Customer confirms that the Waste presented for collection is under their control and that they have the legal right to arrange its removal and disposal.

10.4 The Company may provide or retain records relating to the transfer and disposal of Waste where required by law or regulation. The Customer may request evidence of proper disposal, which the Company will provide where reasonably available.

10.5 The Customer must not knowingly misdescribe Waste or conceal hazardous items within general rubbish. If the Company discovers such items, it may return them to the Customer, charge additional handling and disposal fees, or notify the relevant authorities where legally required.

11. Delays and Events Beyond Control

11.1 The Company shall not be liable for any delay or failure to perform the Services where such delay or failure is due to events beyond its reasonable control, including but not limited to extreme weather, road closures, accidents, strikes, breakdowns, or legal restrictions.

11.2 In the event of such circumstances, the Company will use reasonable efforts to inform the Customer and to perform the Services as soon as reasonably practicable.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, providing details of the issue and any supporting information.

12.2 The Company will investigate complaints in a fair and timely manner and will seek to resolve any disputes amicably with the Customer.

12.3 If a dispute cannot be resolved directly, the Customer may have rights to pursue further remedies under consumer protection legislation or through the courts.

13. Data Protection and Privacy

13.1 The Company may collect and process personal data relating to Customers for the purposes of providing the Services, managing bookings, processing payments, and fulfilling legal obligations.

13.2 The Company will handle personal data in accordance with applicable data protection laws and will take reasonable steps to keep such data secure.

13.3 The Customer is responsible for ensuring that any personal data they provide is accurate and for notifying the Company of any changes relevant to the provision of the Services.

14. Amendments to These Terms

14.1 The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, services, or business practices.

14.2 The version of the Terms and Conditions in force at the time of the Customer’s booking will apply to that booking, unless changes are required by law or expressly agreed with the Customer.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

16. General Provisions

16.1 If any provision of these Terms is held by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by the Company in exercising any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy.

16.3 The Customer may not assign or transfer any of their rights or obligations under these Terms without the prior written consent of the Company.

16.4 Nothing in these Terms shall create a partnership, joint venture, or agency relationship between the Company and the Customer.
